How the Driver Education Fund receives $$ in order to Reimburse public schools for driver education

 

 

There are basically two sources of revenue that end up doing into the Driver Education Fund in Illinois:

 

1.       RECEIPTS FROM SECRETARY OF STATE – 2/3 of $ come from this resource

2.       RECEIPTS FROM CLERKS OF CIRCUIT COURTS – 1/3 of $ come from this resource

 

From the Illinois Secretary of Sate*

Amount of $$ to Driver Education Fund

Driver permits

$16 out of each $20

Original License

$5 out of each $10

Restricted Driving Permit

$4 out of each $8

Clerks of the Circuit Courts**

 

Directly to Driver Education Fund

$4 for every $40 fine

From co-mingled county fund

Transfer 1/3 of funds to Driver Education Fund

Co-mingled Trauma Fund

Transfer 3/17 of funds to Driver Education Fund

 

*These fines are limited to certain traffic conviction which are reportable to the Illinois Secretary of State.  For example, P Tickets (so called local ordinance tickets/parking tickets are not reportable to Illinois Secretary of State, so there are no $$ that go into the Driver Education Fund.

 

 

**Clerks must remit within 1 month to state treasurer and shall submit by march 1 each year to the state comptroller a report of the amount of funds remitted for the previous year.  The following items can result in a reduction of $$ going into the Driver Education Fund: 

  1. judicial discretion (i.e., a judge ruling that some $$ will not go into the Fund [very rare])
  2. where there is a conviction and reduction of fines and penalties (less $$ going into the Fund)
  3. court supervision for 30, 60, or 90 days (usually fines are not paid and go record goes to the Illinois Secretary of State).
